Abstract [en]

The purpose of this thesis is to examine the REACH regulation, the WEEE and RoHS directives and their implementation in Swedish law. The starting point was principally to clarify the responsibility for identifying and generating content for waste management as importers of electronic goods imported from non-EU countries. The examination was carried out through studies of the EC legal acts as well as the Swedish legislation changed or added. Information from the responsible authorities, literature and reports have also been used in the review. The results showed that electronic products are covered by the legislation. Responsibility for identification of contents, and waste management has, in effect, and with the acts, the authorities moved in to the importing company. The reviews of the REACH regulation has shown that its requirements are targeted directly at importers of goods. The requirements relating to registration or notification of certain substances contained in products and information on these topics to the buyers of the products. In addition, importers must also comply with the restrictions imposed in the Union. The regulation was shown to contain some ambiguities: Companies that import goods into smaller lots, where the quantity of the hazardous substances does not exceed the regulated level, is not affected by the regulation rules. There are also limitation in the information requirements as they apply only to the substance itself and not its use in the specific product. Further examination showed that the regulation of the content of hazardous substances in products import is defective in that the RoHS Directive only regulates certain substances in certain electronic products. Regarding existing waste management of electronic products, the results showed that producer responsibility has become relatively widespread in the WEEE Directive's implementation. In addition to responsibility for waste disposal, the producer is also responsible for disseminating information and the labeling of products. This responsibility also concerns many importing companies.
