Abstract [en]

This thesis has examined freedom of religion based on the Swedish constitution Act (1974: 152), chapter 2, and the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) Article 9 (1-2). Freedom of religion is defined according to the ECHR Article 9 as a freedom to change religion or belief, to manifest religion or belief, in worship, teaching, practice and observance.The object was to clarify the law's view on the Muslim veil regarding freedom of religion and to clarify the disproportions that are.While the law sees the veil as incompatible with gender equality and women's oppression, is Islam’s purpose of the veil and the view of the woman completely different.Oppression of women have neither place nor support in Islam, on the contrary, the Muslims are ordered to treat women with respect. The Qur'an and Prophet Muhammad's statements are a number of verses about how women should be treated, and that women and men are equal to God.Religion and religious practice is more limited than what the law express. Some religious symbols and signs that can be regarded as self-evident rights, such as the veil and the cross is not at all guaranteed protection under ECHR Article 9, on the contrary, it is also free for states to restrict and prohibit them.In many of the cases are religious symbols considered constitute a threat to democracy, other people's respect and gender equality.
